Welcome to Flowbird Inc. ("Flowbird," "the Company," "we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of our platform, website, and services (collectively, the "Service").

1. Eligibility and Acceptance

By creating an account or using the Service, you agree to these Terms.

  • Age and Residency: You must be at least 18 years of age and a resident of the United States to use the Service.
  • Business Use and Authority: If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization. You are responsible for all activity by users you add to your account.
  • California Notice at Collection: For residents of California, please see our Privacy Policy for a full list of categories of personal information we collect and the purposes for which that information is used.

2. Plans and Usage Limits

The Service is offered under subscription plans (currently Starter, Pro, Max, and Enterprise). The number of users, products, new ideas per month, and other limits included in each plan are described in the Pricing section of our website (www.flowbird.ai) at the time you subscribe or renew, and form part of these Terms.

  • Monthly Allowances: Allowances such as new ideas per month reset each billing cycle and do not roll over. Once you reach a limit, you can upgrade your plan or wait for the next cycle.
  • Users: Each user seat is for one named individual within your organization. Login credentials may not be shared.
  • "Unlimited" Features: Features described as "unlimited" are subject to Fair Use (Section 5).
  • Enterprise: Enterprise plans are governed by a separate order form. If the order form conflicts with these Terms, the order form controls.

3. Subscriptions, Trials, and Billing

  • 14-Day Free Trial: New customers may start with a 14-day free trial of the Starter plan. No credit card is required to begin the trial. Access ends when the trial ends unless you choose a paid subscription.
  • Payment Processing: Payment processing services are provided by Stripe. By using the Service, you agree to be bound by Stripe's Services Agreement. Flowbird does not store your full credit card information.
  • Fees and Automatic Renewal: Pricing is set forth on our Pricing section of our website (www.flowbird.ai). Your subscription will automatically renew at the end of each billing cycle unless you cancel through your account settings before the renewal date.
  • Plan Changes: Upgrades take effect immediately and are prorated. Downgrades take effect at the start of the next billing cycle.
  • Refunds: Fees are non-refundable except where required by law.

4. Plan Modification and Sunsetting

As the Service evolves, the Company may modify, change, or discontinue specific plans.

  • Right to Cancel: We reserve the right to cancel any plan for existing users.
  • Notice: In the event of a plan cancellation or a price increase, we will provide you with at least thirty (30) days' notice via email. We may offer you the option to transition to a new commercial plan.

5. Intended Use, Fair Use, and Misuse

The Service is intended for product management, strategy, and research purposes by your internal team.

  • Fair Use of "Unlimited" Features: Where a plan describes a feature as "unlimited" (for example users, products, new ideas, interviews, or personas), this means we do not set a fixed numerical cap for normal business use. It does not mean infinite use. Unlimited features are subject to reasonable use, as determined by Flowbird in its reasonable discretion, taking into account the typical usage of customers on the same plan and the load placed on our infrastructure and third-party AI providers.
  • Excessive Use: If we determine that your usage is excessive, we may (i) ask you to reduce your usage, (ii) throttle, rate-limit, or cap the affected features, (iii) require you to move to a higher plan or an Enterprise agreement, or (iv) suspend the affected features or your account. We will make reasonable efforts to notify you before limiting or suspending your usage, except where immediate action is needed to protect the Service, other customers, or our providers.
  • Prohibited Conduct: You agree not to use the Service for automated data scraping, training competing AI models, generating bulk non-product-related content, accessing the Service through scripts or automation other than interfaces we provide, or reselling or providing access to anyone outside your organization.
  • Termination Right: The Company reserves the right to suspend or remove any user immediately, without notice or refund, if we determine the Service is being used against its intended purpose, in a way that places an undue burden on our infrastructure, or excessively after we have asked you to reduce usage.

6. Intellectual Property (IP) and Feedback

  • Ownership: You retain ownership of your inputs. Flowbird owns the Service, the underlying code, and the proprietary architecture, logic, and instructions used to power the AI agents.
  • Feedback License: By providing suggestions or ideas ("Feedback"), you grant the Company a perpetual, irrevocable, royalty-free, and worldwide license to use and incorporate such Feedback into our products without compensation to you.

7. AI-Generated Content Disclaimer

The Service uses chat-based AI services and AI agents to autonomously generate content, suggestions, product insights, and other outputs based on the information you provide.

  • Accuracy: You acknowledge that such AI-generated output may be incomplete, inaccurate, or otherwise flawed, and is provided for informational purposes only.
  • Responsibility: You remain solely responsible for verifying the accuracy, appropriateness, and usefulness of any AI-generated content before relying on or acting upon it. Flowbird disclaims any liability arising from decisions made based on such output.

8. Limitation of Liability

To the maximum extent permitted by law, Flowbird Inc.'s total liability for any claim shall not exceed the total amount paid by you to the Company in the twelve (12) months prior to the event giving rise to the claim.

9. Governing Law

These Terms are governed by the laws of the State of Illinois, and disputes shall be resolved in the state or federal courts located in the Northern District of Illinois.

10. California-Specific Disclosures

California residents have the right to (i) know what personal information we collect, (ii) delete personal information, (iii) correct inaccuracies, and (iv) opt-out of the "sharing" of personal information for cross-contextual advertising. To exercise these rights, contact support@flowbird.ai.
