Terms of Service

Effective Date: February 1, 2026

Welcome to Flowbird Inc. ("Flowbird AI," "the Company," "we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of our platform, website, and services (collectively, the "Service").

1. Eligibility and Acceptance

By creating an account or using the Service, you agree to these Terms.

  • •Age and Residency: You must be at least 18 years of age and a resident of the United States to use the Service.
  • •California Notice at Collection: For residents of California, please see our Privacy Policy for a full list of categories of personal information we collect and the purposes for which that information is used.

2. The "Flowbird Preview" Plan and Usage Limits

During this commercial launch phase, your use of the Flowbird Preview plan is subject to the following limitations:

  • •Account Seats: One (1) user seat per subscription.
  • •Usage Caps: Two (2) Products, five (5) Personas per product, and twenty (20) Features per product.
  • •Included Features: Unlimited AI persona interviews, AI Chat interactions, and Document uploads, subject to our Fair Use policy (Section 5).
  • •Availability: The Company reserves the right to limit the availability of the Preview plan by timeframe or by a maximum number of subscribers at our sole discretion.

3. Subscriptions, Trials, and Billing

  • •14-Day Free Trial: The Preview plan begins with a 14-day trial period. No credit card is required to begin the trial. Access will terminate unless you choose a paid subscription.
  • •Payment Processing: Payment processing services are provided by Stripe. By using the Service, you agree to be bound by Stripe's Services Agreement. Flowbird AI does not store your full credit card information.
  • •Fees and Automatic Renewal: Pricing is set forth on our Pricing section of our website (www.flowbird.ai). Your subscription will automatically renew at the end of each billing cycle unless you cancel through your account settings before the renewal date.

4. Plan Modification and Sunsetting

As the Service evolves, the Company may modify, change, or discontinue specific plans.

  • •Right to Cancel: We reserve the right to cancel the Preview plan for existing users.
  • •Notice: In the event of a plan cancellation or a price increase, we will provide you with at least thirty (30) days' notice via email. We may offer you the option to transition to a new commercial plan.

5. Intended Use and Misuse

The Service is intended for product management, strategy, and research purposes.

  • •Prohibited Conduct: You agree not to use the Service for automated data scraping, training competing AI models, or generating bulk non-product-related content.
  • •Termination Right: The Company reserves the right to suspend or remove any user immediately, without notice or refund, if we determine the tool is being used against its intended purpose or in a way that places an undue burden on our infrastructure.

6. Early Adopter Perk: Founder Slack Channel

The first twenty-five (25) paying customers will receive an invitation to an exclusive Slack channel.

  • •Discretionary Nature: Access is a promotional "bonus" and is not a core part of the Service.
  • •Right to Terminate: Flowbird AI reserves the right to terminate this offer, close the channel, or change the format of communication at any time and for any reason, without notice or liability to you.

7. Intellectual Property (IP) and Feedback

  • •Ownership: You retain ownership of your inputs. Flowbird AI owns the Service, the underlying code, and the proprietary architecture, logic, and instructions used to power the AI agents.
  • •Feedback License: By providing suggestions or ideas ("Feedback"), you grant the Company a perpetual, irrevocable, royalty-free, and worldwide license to use and incorporate such Feedback into our products without compensation to you.

8. AI-Generated Content Disclaimer

The Service uses chat-based AI services and AI agents to autonomously generate content, suggestions, product insights, and other outputs based on the information you provide.

  • •Accuracy: You acknowledge that such AI-generated output may be incomplete, inaccurate, or otherwise flawed, and is provided for informational purposes only.
  • •Responsibility: You remain solely responsible for verifying the accuracy, appropriateness, and usefulness of any AI-generated content before relying on or acting upon it. Flowbird AI disclaims any liability arising from decisions made based on such output.

9. Limitation of Liability

To the maximum extent permitted by law, Flowbird Inc.'s total liability for any claim shall not exceed the total amount paid by you to the Company in the twelve (12) months prior to the event giving rise to the claim.

10. Governing Law

These Terms are governed by the laws of the State of Illinois, and disputes shall be resolved in the state or federal courts located in the Northern District of Illinois.

11. California-Specific Disclosures

California residents have the right to (i) know what personal information we collect, (ii) delete personal information, (iii) correct inaccuracies, and (iv) opt-out of the "sharing" of personal information for cross-contextual advertising. To exercise these rights, contact support@flowbird.ai.
